Smart Way Services Inc. d/b/a Zoofilist – Terms of Service
Effective Date: February 1, 2026
These Terms of Service (“Terms”) govern your use of the Smart Way Services Inc. d/b/a Zoofilist website, mobile application, APIs, content, products, and services (collectively, the “Services”).
Zoofilist is a technology platform that connects pet owners with independent pet service providers (“PSPs”). Zoofilist does not provide pet care services directly.
IMPORTANT NOTICE: These Terms include a binding arbitration agreement and class action waiver requiring disputes to be resolved on an individual basis.
1. Independent Service Providers
All pet service providers on Zoofilist operate as independent contractors, not employees of Zoofilist. Providers set their own availability, services, and prices.
- Providers must be at least 18 years old and authorized to work.
- Providers are responsible for licenses, permits, and insurance.
- Zoofilist performs limited background checks and disclaims their accuracy.
- Boarding services are limited to 12 hours (provider sets time window).
- House sitting is a 24-hour service including feeding, litter care, playtime, and dog walks. Providers may leave the home as agreed with the owner.
2. Booking & Availability
Bookings are confirmed only after acceptance through the Zoofilist app. Availability reflects the provider’s selected schedule.
- Pet owners must provide accurate pet profiles and travel disclosures.
- If traveling without house sitting or boarding, owners are strongly encouraged to book minimum drop-in services for pet safety.
- Failure to disclose travel or booking insufficient care waives claims against Zoofilist and PSPs for resulting harm.
3. Payments & Fees
All payments must be processed through the Zoofilist platform. Prices are set by service providers and may vary by pet, service type, or special rates.
- Payments are authorized at booking and held in escrow via Stripe.
- Off-platform or cash payments are prohibited and may result in termination.
- Zoofilist charges disclosed service fees or commissions.
4. Cancellations & Changes
Cancellations and changes must be made through the Zoofilist platform. Refund eligibility depends on timing and service type.
- 24+ hours before service: full refund (minus service fees).
- Less than 24 hours: partial or no refund depending on circumstance.
- No-shows may result in forfeiture and account review.
5. Communication & Conduct
Users must communicate respectfully and professionally. Harassment, discrimination, unsafe behavior, or misconduct may result in suspension or termination.
- No guests or parties at a pet owner’s home without permission.
- Pet photos may not be shared externally without explicit owner consent.
- Violations may result in enforcement actions.
6. Pet Health & Safety
Pet owners are responsible for providing accurate health, behavior, and vaccination information. Providers may refuse service if safety risks exist.
7. Reviews & Feedback
Reviews must be truthful and respectful. Zoofilist may remove reviews that violate platform policies.
8. Insurance & Liability
Zoofilist is not liable for injuries, losses, or damages arising from services provided by independent PSPs. Users agree to indemnify Zoofilist against third-party claims.
9. Platform Use
Misuse of the platform, fraudulent activity, or fee circumvention may result in immediate account termination.
10. Pet Emergencies & Veterinary Authorization
In emergencies, providers are authorized to seek veterinary care at the owner’s expense if the owner cannot be reached.
11. Dispute Resolution & Arbitration
Disputes are resolved through binding arbitration on an individual basis. Class actions and jury trials are waived.
12. Privacy
Use of the platform is subject to the Zoofilist Privacy Policy.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Our Commitment
By using Zoofilist, you agree to these Terms. Continued use after changes constitutes acceptance. If any provision is found invalid, the remaining provisions remain in effect.
